Official Prize Drawing Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. Entry does not require a substantial expenditure of time or effort. Entrants do not buy anything in order to have a chance to win. These official rules (”Rules”) apply to the Monthly SavvyConnect Sweepstakes prize drawing (”Prize Drawing”) conducted by Luth Research, 404 Camino del Rio South, Suite 505., San Diego, CA 92108 (the ”Sponsor”). By entering the Prize Drawing, you agree to be bound by these Rules.
1. ELIGIBILITY
All legal residents within the United States of America who: (i) are at least 13 years of age; (ii) who have computer access and Internet access; (iii) and who install, or have already activated, the SavvyConnect Browser Extension or Android Mobile app will be eligible to win the drawing prize, with the exception of employees, their immediate family and household members of Sponsor, Sponsor’s parent companies, divisions, subsidiaries, affiliates, advertising and production agencies. Void anywhere where otherwise prohibited, taxed or restricted. This Prize Drawing is governed by and subject to all U.S. federal and applicable state and local laws and regulations.
2. PROMOTION PERIOD
Eligible persons will be those who install the SavvyConnect browser extension or Android app, or have an already activated extension/app on their device during the Promotion Period. This includes anyone who has previously installed and still has the SavvyConnect Android app or browser extension active on their device. Promotion period for this $1000 incentive will be based on calendar months, beginning on November 1, 2023 at 12:00 am Universal Time Coordinated (UTC.) The promotional period will run monthly, with no current end date. While there is currently no set end date for the promotional period, in the event of a decision to conclude the promotion, participants will receive due notice before its termination.
3. HOW TO ENTER AND WIN
(a) During the Promotion Period, any eligible person (as defined in Section 1 of these Rules) who installs or already has the SavvyConnect browser extension or Android App (“Entrant”), will receive one (1) entry into the Prize Drawing per qualified device type for a maximum of three (3) entries per month. A qualified device type is defined as one of the three following types: a “PC” (any browser extension install to any desktop, laptop, or other similar computer browser,) a “Phone” (as classified by the member’s SavvyConnect Status page,) or a “Tablet” (as classified by the member’s SavvyConnect Status page).
(b) Once the Promotion Period has ended, the Sponsor will conduct a random drawing to select one (1) winner from all eligible entries received. The drawing will be conducted within two weeks of the end of the Promotion Period. The Sponsor will credit the winning member’s SurveySavvy Account the $1000 incentive and make reasonable efforts to notify the winners by e-mail within approximately ten (10) days of the completion of the random drawing, provided that the winner has complied with the Publicity requirements set forth in Section 5 below. If the prize winner’s e-mail notification is returned as undeliverable, the prize winner’s SurveySavvy account or e-mail address is no longer active, or the prize winner does not comply with these Rules, said prize winners will forfeit their right to the prize and an alternate prize winner will be selected in a new random drawing. This process will be repeated until the prize has been successfully awarded.
(c) All entries become the property of the Sponsor and will not be returned or acknowledged. Incorrect, incomplete, late, and any other type of defective entry will automatically be disqualified.
4. WINNER AND PRIZE
(5) Prize will be awarded consisting of a single $1000 incentive credit. The prize will be automatically credited to the winning member’s SurveySavvy account and can be requested immediately upon deposit. . Winner may not substitute their prize. There will be one (1) winner. The odds of winning depend upon the number of eligible entries received. All payment, filing and reporting of any and all federal, state and local taxes on winnings are winner’s responsibility. Winner may be required to provide their social security number and/or tax identification number for tax purposes. Winner may be required to provide Sponsor with proof that the winner is the authorized account holder of the e-mail address associated with the winning entry, or a family member of the authorized account holder of the winning entry. ”Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
5. PUBLICITY
At the sole discretion of Sponsor, prize winner may be required to sign and return an Affidavit of Eligibility and Release of Liability/Publicity Release within seven (7) days of the date that Sponsor notifies him or her of their prize or he/she will be disqualified and an alternate winner will be selected as described above. Winner must meet all criteria in these Rules or face forfeiture of their prize based upon the sole discretion of Sponsor. Except where prohibited by law, entry into the Prize Drawing constitutes express permission to use winner’s name, likeness, hometown, and prize won for promotional purposes without further compensation. However, acceptance of the prize is not conditioned on Sponsor’s ability to use winner’s name.
6. WARRANTY DISCLAIMER/RESERVATION OF RIGHTS
Winner acknowledges that Sponsor, its clients, and their respective parent companies, affiliates, subsidiaries, divisions and advertising and promotion agencies and their respective employees and agents do not make, nor are in any manner responsible or liable for any warranties, representations, guarantees, expressed or implied, in fact or in law, relative to the quality, conditions, fitness, or merchantability of any aspects of the Prize Drawing or the prize. Sponsor may terminate the Prize Drawing or any portion thereof or decide to modify it in any manner, which it deems fair and equitable to participants if it becomes aware of any occurrence, which would materially affect the security, fairness or proper play of the Prize Drawing. Sponsor may prohibit individuals from participating in the Prize Drawing and disqualify entries if: (i) participants attempt to enter the Prize Drawing through any means other than as described in these Rules; (ii) participants attempt to disrupt the Prize Drawing or circumvent the terms and conditions of these Rules in any way; or (iii) participants repeatedly show a disregard for the Prize Drawing Rules, act in an unsportsmanlike manner, or act with an intent to annoy, abuse, threaten, or harass any other entrant or Sponsor. Sponsor expressly reserves the right to resolve any discrepancies, disputes, or otherwise unforeseen circumstances, and Sponsor’s decision will be final. Sponsor expressly reserves the right to change or alter Rules at any time.
7. LIMITATION OF LIABILITY
Neither Sponsor, its clients, nor their respective parent companies, affiliates, subsidiaries, divisions, advertising or promotion agencies or their respective employees and agents shall be responsible for any technical, hardware, or software malfunctions, interruptions or unavailability, failed transmissions over any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Prize Drawing, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Prize Drawing or downloading any materials from Sponsor’s web site during this Prize Drawing. By participating in this Prize Drawing, all entrants agree to release Sponsor, its clients, and their respective parent companies, affiliates, subsidiaries, divisions and advertising and promotion agencies and their respective employees and agents from any and all liability for any loss, harm, damages, costs or expenses of any kind, including without limitation property damages, personal injury and/or death, arising out of participating in this Prize Drawing, or the acceptance, possession, use or misuse of any prize, or while preparing for, participating in and/or traveling to or from any prize related activity and claims based on rights of publicity, rights of privacy, defamation or prize delivery. By entering the Prize Drawing, participants agree to be bound by these Rules and the decisions of Sponsor. Information collected by Sponsor during this Prize Drawing will be used subject to Sponsor’s Privacy Policy.
